CWC Decisions-May 2011

Decision of CWC Meeting, was held in Jain Dharmashala, Paharganj, New Delhi on 29th, 30th of May 2011

CWC meeting, which was held on 29th, 30th May 2011, presided over by Com. L. Many assisted by Com. N. Sarkar Working President took the following decisions after a threadbare discussion.

1. It came into the notice that AIRF was meeting with Railway Board on the question of rate of Kilometer-age on 8th May, so we decided to send a representation to CRB centrally immediately, copy to AIRF / NFIR detailing our views and we should be observed demand day on 06.06.2011 on all the depots all over country, submitting the memorandum to CRB through CCC / IC, advance copy to CRB through speed post C / to AIRF / NFIR too.

NB: - The memorandum, was sent to CRB, copy to AIRF / NFIR Centrally which was served upon all the three parties on 04.06.2011 only well before the meeting on 8th June.

2. It is decided to submit a memorandum to Hon’ble PM (In-charge of Railway), Hon’ble Chief Justice Supreme Court and other High Court.

3. It has also been decided that if our demands are not met by end of July then we shall be left with no option but to go working in fast / sitting in fast all over country a notice of which will be served to each of GM through massive demonstration, 45 days before the commencing the “Fast”.

4. To formulate the mode and manner, and the date, a committee is constituted with the following Com: -

5. It has also been decided to hold a regional workers convention in the month of July. The date and place be decided with mutual consultation of participating Zones but must be in July 2011. or by first week of Aug 2011

i) SR, SWR, and S.C. Railway - jointly – com. K. C. James, will Co-ordinate.

ii) S. E. Railway and E. Co. Railway – Jointly – Com. N. B. Dutta will Co – ordinate

(It is suggested to hold it either one day before or later in continuous to the BGM of S. E. Railway at ROU on 23rd, 24th July or in after noon, if BGM is completed in 1st half on 24th July)

iii) E.C. Railway, and N.E. Railway–Com. Dinesh Prasad Srivastava– will Co – Ordinate

(It is suggested to hold it on 2nd Aug’ 2011 either at SPJ or MFP or SEE where ever, convenient)

iv) E. Railway, N. F. Railway, and Metro Kolkata – Com. N. Sarkar – will Co – Ordinate

(It is suggested to hold it at Malda as suggested by Com. Sarkar any day in-between 14th, to 16th July, if can be held will be convenient to me to attend.)

v) N. Railway is holding its workers’ meeting at Haridwar on 3rd July, it will be better if N. C. R is mobilized there. Com. P. C. Jha will be responsible for that

vi) N. W. Railway, W. C. Railway, W. Railway – Com. Luna Ram will Co-Ordinate and decide the convenient place and date. It will be better if date will be on 6th July at Bhopal or the place, suits them.

vii) C. Railway, SEC Railway – M. P. Deb will Co-Ordinate and decide the place. It will be convenient, if they decide to hold it on 12th July, preferable it will better, if it will be at either at NGP or BSP.

6. An editorial Board has been constituted for Fire (Hindi) with the following Coms;

7. It is tentatively decided that All India BGM will be held at Bangalore in S. W. Railway in May 2012 and delegation fee will be Rs. 500/- per delegate. Com C. Sunish will take an appropriate step in that direction.

Notice on Running Allowance

RUNNING ALLOWANCE.

Till recent years Running Allowance was a glamour of Running Staff. But today the condition is different. When DA raised to 51% w.e.f 01/01/2011, many of the allowances automatically raised by 25% as per accepted recommendation of 6th CPC and this includes Travelling Allowance also. Hence there are lot of expectations among the Running Staff to get enhanced rate of running allowance. But it is not applicable to running allowance as per existing orders. Thus it is imperative to look at the problem more deep and analyze various facts.

Though the running allowance scheme continues from Company Railways regime, prior to 1980 revising Running Allowance was after every pay commission without any scientific analysis. After 1970s, many struggles by the Loco Running Staff, the Railways and the Government of India had accepted the genuineness of the demand of scientific analysis and formed Running Allowance Committee 1980.

RAC1980 identified two elements in running allowance, ie. Pay element and TA element and somehow quantified them through some guess work. RAC 1980 derived a methodology (formula) to calculate rate of Running Allowance. Accordingly revision of running allowance was done for the past two decades based on the RAC1980 formula. Despite our disputes over various factors we principally accept the RAC1980 methodology.

After 6th CPC, Railways constituted a committee under the Chairmanship of Adv(IR) along with five Railway Bd Officials and two General Secretaries of NFIR and AIRF. It has submitted its recommendation on 25.11.2008. The committee vide Para14, assumed that the TA / DA rate at Rs. 210/-, and took the minimum of pay band (PB2) and calculated rate of running allowance as rs 160/- per 100 kms but subsequently TA / DA has been released fixing Rs. 340/- for the grade pay of Rs. 4200/-. So instead of Rs. 210 an amount of Rs. 340 should have been taken as TA for fixing the running allowance rate. In the case of Assistant Loco Pilots the increase in TA rates is from Rs. 55 to Rs.210 i.e, 3.81 times. Therefore the recommendation of the committee on Running Allowance to double the rate w.e.f 01.09.2008 is unjust, unacceptable and clear discrimination. Now as DA raised 51%, TA is raised as Rs.425.

Accordingly it will be just on our part to demand that the kilometerage rate of running staff be raised as follows:-

Application of RAC-1980 formula with 20 days TA and 4700 / 3725 km for LP / ALP, the rate from 01.01.2006 to 31.08.2008, w.e.f 01.09.2008,and w.e.f 01.01.2011

Following the footsteps of RAC1980, this joint committee also vide Para.13 submits “as Kilometerage allowance contains a Pay element, revision in the rates of this allowance requires to be carried out w.e.f 01-01-2006 and thereafter w.e.f 01-09-2008 when the revised rates of TA/DA are implemented”. And thus they derived separate Kilometerage allowance w.e.f 01-01-2006 and 01-09-2008. But it concluded with doubling the rate of running allowance w.e.f 01-09-2008 only. Thus we are going back to pre 1980 position ie revising Running Allowance without any scientific analysis. Revision of running allowance rates on increase of Basic pay or TA is mandatory in accordance with running allowance rules 1981.

After a meeting with Member Staff and Advisor (IR) on 13-01-2011 AIRF stated that now MS has agreed to start a negotiation on the issue of improvement in the rate of running allowance. When a golden opportunity was extended through FTC both federations took an unfortunate stand that “ not to associate with the committee” and there by deprived loco running staff legitimate allowance.

A negotiating channel of federations so far yielded no results in the improvement of pay and running allowances. The loco Running staff largely desire for united struggle to restore the RAC 1980 formula for running allowance to ensure proper and just rate and periodic revision. AILRSA gives open call for united struggle at least on issue basis to fulfill the workers wishes.

High Power Committe on HOER

GOVERNMENT OF INDIA MINISTRY OF RAILWAYS (RAILWAY BOARD)

No:ERB-1/2011/18 New Delhi dated 25.05.2011

Ministry of Railways(Railway Board) have decided to constitute a High power Committee to review the duty hours of running and other safety categories of staff on Railways under the chairmanship of Sri DP Tripathi, Ex Secretary, Ministry of Food processing Industries. The other members of the committee will be as under.

i) Sri VK Manglik, Ex GM, West Central Railway - Member.

ii) Sri. MS Khan, Ex.AM/Finance/Railway Board -Member

iii) Sri DS Baveja,Ex CEE, Western Railway - Member

Sri Anil Kumar Gulati, Chairman, HRRC, Railway Board will be Secretary to the Committee.

2. The Committee would examine, review and recommend on the following

i) Daily/weekly duty hours and rest at head quarters and out station for the running staff in all categories of trains.

ii)To review list of safety categories on the Railways, and recommend daily/weekly duty hours and weekly off for the staff in safety categories.

iii)Monetary compensation for work beyond duty hours/breach of rest in exigencies of service for running staff/staff in safety categories.

iv) Resting facilities and other provisions for out station rest of running staff , and

v) Any other issue ancillary to the above or which may be specifically referred to the committee by the Railway Board during its tenure.

3) The head quarter of the committee will be at New Delhi.

4) The tenure of the committee shall be for one year from the date of its constitution.
